Please read these Terms of Service ("Terms") carefully before using the Nudge mobile application (the "Service") operated by Cold Coffee Apps ("us", "we", or "our") located in Delhi, India.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Nature of the Service

Nudge is a productivity tool designed to restrict access to applications and websites based on rules defined by the user. You acknowledge that the core functionality of the Service is to block access to your device or specific applications.

2. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. COLD COFFEE APPS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN.

3. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COLD COFFEE APPS BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

• MISSED COMMUNICATIONS: WE ARE NOT LIABLE FOR MISSED CALLS, EMAILS, MESSAGES, ALARMS, OR EMERGENCY NOTIFICATIONS RESULTING FROM THE APP'S BLOCKING FUNCTIONALITY.
• DEVICE ACCESSIBILITY: WE ARE NOT LIABLE FOR YOUR INABILITY TO ACCESS YOUR DEVICE, DATA, OR THIRD-PARTY APPS DUE TO BLOCKING RULES, STRICT MODE, OR SOFTWARE BUGS.
• AI OUTPUTS: WE ARE NOT LIABLE FOR ANY INCORRECT, OFFENSIVE, OR MISLEADING ADVICE GENERATED BY THE AI COACH FEATURES.
• DATA LOSS: WE ARE NOT LIABLE FOR ANY LOSS OF DATA OR PROFIT ARISING OUT OF THE USE OF THE SERVICE.

YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

4. AI Features Usage

The Service allows for interaction with an Artificial Intelligence (AI) Coach. You agree that:

• The AI is not a human and not a mental health professional.
• You will not use the AI to generate or promote illegal, abusive, or harmful content.
• We reserve the right to suspend your access to AI features if we detect abusive usage patterns.

5. Subscriptions and Refunds

Subscriptions are processed exclusively through the Google Play Store. We do not handle your financial information directly.

• Renewals: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Refunds: All refund requests must be directed to Google Play. We do not have the ability to process refunds directly.

6. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
